PLEASE READ THIS AGREEMENT CAREFULLY BEFORE ACCESSING THE SERVICE. BY ACCESSING THE SERVICE OR ESTABLISHING AN ACCOUNT, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS BELOW. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT ACCESS OR USE THE SERVICE. PLEASE NOTIFY TRANSWORLD NETWORK IMMEDIATELY SO THAT WE MAY TERMINATE YOUR ACCOUNT.

1. MoonLink Network, a division of Transworld Network, Inc.("Transworld") agrees to provide Internet access and services ("Service") to the User ("Subscriber") under the following terms and conditions contained in this Agreement ("Agreement").

2. Transworld may revise, amend or modify this Agreement, terms and conditions and/or modify prices, as well as change services that are offered upon fifteen (15) days notice, published on-line via MoonLink.Net's website, email, or US Mail. Transworld may discontinue all other aspects of the Services at its sole discretion and without prior notice.

3. Subscriber agrees to indemnify and hold Transworld, its affiliates, its contractors, its agents, or their respective employees harmless against any and all liability, loss, claim and expense including attorney's fees, resulting from the Subscriber receiving Transworld's services which cause direct or indirect damage to another party.

4. Transworld's Service includes, but not limited to, unlimited Internet access to the World Wide Websites. Some of the discussions may contain language or pictures intended for Adult audiences. Subscriber also understands that the Internet contains unedited materials, some of which are sexually explicit or may be offensive. Subscribers must be at least 18 years of age. All Subscribers must return a signed Customer Agreement form or acknowledgement within 14 days of subscribing, or service will be deactivated. Minors accessing the Service, under 18 years of age must have a parent or a legal guardians signature on the Customer Agreement form to agree to these conditions and to indicate acceptance and knowledge of these terms. By downloading MoonLink.Net via online or CD, you are automatically accepting our Agreement and may not be required to sign the Customer Agreement Form.

5. Subscriber will be given access to Transworld's system, provided that Subscriber provides accurate and complete Billing information including Legal name, address, telephone number, and credit card or Billing information. Payment must be made in advance by check or a major credit card.

6. Subscriber shall pay in accordance with the provisions of the Billing Option selected by Subscriber, any set-up or monthly fees, connect time charges, minimum charges and other charges incurred by Subscriber. Account will start from the day when Subscriber orders service. Service Fee will not be pro-rated and will be effective from the first of the month, by activating the account. Service fees are recurring regardless of use or non-use of Transworld's Services until Subscriber cancels account.

7. Subscriber will select a Billing option. Options include Monthly Automatic Credit Card Deduction (Visa, MasterCard, Discover or American Express), or Invoicing. Transworld will process Credit Cards automatically on or around the First (1st) of every month. In the event that an Automatic Debit (Credit Cards/Checks) is returned or rejected from the issuing bank for any reason (e.g. due to insufficient funds from the bank, expired dates on Credit Cards, or a change in bank/credit card accounts) a Return Item processing fee of $25.00 will be charged. Subscribers will be notified at that time and a payment must be made forthwith. All Subscribers paying by Credit Card must sign an Automatic Deduction Authorization Form or acknowledge an eForm via email address on file.

8. Billing Invoices are sent out on a Monthly, Quarterly, Semi-Annually, or Annually to the Subscriber Thirty (30) days prior to the First (1st) of the month. Account balances are due and payable by the First (1st) of every month. Any account balances that remain unpaid Ten (10) days after the due date, a late fee of $15.00 will be automatically charged. In the event the Subscriber's account is not paid in full within Twenty (20) days from the due date, the account will be De-Activated. To remove an account from the De-Activated status, a service re-connection charge equal to the currently charged set-up fee may be charged. A De-Activated account will continue to accrue charges until cancelled.

9. If notice of dispute as to charges is not received by Transworld in writing within thirty (30) days after the billing invoice is issued, the invoice shall be considered correct and binding upon the customer. The Subscriber has the right to have any erroneous entry corrected on their bank/credit card statement within forty-five (45) days after a debit was made. Please contact our Billing Dept for any questions.

10. Transworld reserves the right to pursue all legal remedies available to secure payment of the delinquent amount from the Subscriber. Delinquent accounts may be subject to an Interest rate of 1% per month on any unpaid amount, commencing 30 days after the due date. In the event it becomes necessary to enforce collection of an unpaid balance, the Subscriber is responsible for and shall pay Transworld all costs of collection, including reasonable attorney's fees and costs. Delinquent accounts will continue to be billed at a monthly rate and all applicable charges, including late fees will continue to accrue until such amount is paid in full.

11. Subscriber is responsible for any local, toll, long-distance or other telecommunications charges incurred by connecting to MoonLink Network. Subscriber must provide all telephone and other equipment and services necessary to access the Service. Transworld is not responsible for non-connection of computers due to configuration problems, insufficient memory, misconfigurations and or other related computer problems. Transworld does not warrant, and is not responsible for the following, and not limited to, any loss of data, delays, lack of access, slow response time, or service interruptions, non-delivery or misdelivery of information, or errors. Loss, delay or non-delivery of data can be due to but not limited to Transworld's own negligence, viruses or other third parties.

12. Subscriber agrees to maintain a secure non-transferable password to their account. Secure passwords are those that are between 6 to 8 characters long and contain upper/lower case letters and/or numbers. The Subscriber agrees not to share the password of their account unless the Subscriber gives permission to a user that resides within the household. Subscriber is responsible for any and all actions on their account. Subscribers may change their password at any time upon notification by the Subscriber to Transworld. The Subscriber acknowledges that the account will be terminated without notice if the Subscriber does not comply. Violation of these terms shall constitute theft of Service and may be prosecuted under civil and criminal law upon Transworld's discretion.

13. Unless otherwise contracted, the Subscriber is limited to 300 megabytes transfer of data monthly via Transworld's Service. The Subscriber is responsible for ensuring that the Subscribers data stored on Transworld's servers are properly backed up on their system. Subscriber also understands that any and all cgi scripting is the property of Transworld. Ham gateways are not allowed.

14. Transworld's Service to the Internet, maintains an inactivity timeout feature set for Fifteen (15) minutes, and a session timeout feature set at Four hundred-eighty (480) minutes in order to conserve system resources. Automatic email messages will be sent in regards to the timeout feature. Subscribers may access the Internet after the session timeout. Only one (1) logon per account is allowed. If Transworld finds a Subscriber using two (2) same logons simultaneously, the Subscriber will be notified and may be charged for the additional logon. De-activation of the account may occur if the Subscriber does not comply after the first notification from Transworld. Subscriber agrees not to use any automatic method to avoid inactivity timeout disconnection.

15. The Subscriber agrees not to violate the security of any computer network, crack passwords or security encryption codes, transfer or store illegal material including that deemed threatening or obscene, or engage in any kind of an illegal activity.

16. The Subscriber understands that Domain Name registrations, whether for Personal or Business are subject to availability and approval from Transworld or an Internet Domain Registration Company. The searching of a Domain Name is free of charge. A fee of Seventy ($70) US Dollars must be prepaid at time of Domain Name registration signup with a major Credit Card. The fee covers for the first Two (2) years, and you will be billed Thirty-five ($35) US Dollars every year thereafter to maintain the Domain Name on the Internet. The registration fee is Non-refundable and Non-transferable. If the Domain Name you requested cannot be registered, our Customer Service Representative will contact you within 48 hours. When Domain Name has been approved and registered, you will be contacted by Email or by phone and Hosting fees and applicable fees will apply.

17. The Subscriber agrees not to use Transworld's Services to conduct any business or activity or solicit the performance of any activity that is prohibited by law. This includes but is not limited to transmission or transfer of obscene or pornographic materials or materials protected by trade secret. Reselling of web space and/or Services without Transworld's authorization is prohibited.

18. The Subscriber posting Personal information to their website will be posted at Subscribers own risk. Transworld will have no liability arising from any use of such information.

19. The Subscriber agrees not to use Transworld's Services to send mass unsolicited advertising, promotional materials, unsolicited bulk commercial email messages to other network users. Forging header information in e-mail, impersonating other users by forging one's email address, use of telecommunication messaging programs, software designed for mass spamming or storage of such programs on Transworld's servers are prohibited and will have their account terminated without notice.

20. The Subscriber agrees not to use Transworld's Services to harm or attempt to harm, minors in any way; Harasses, threats, or encouraging bodily harm or the destruction of property are prohibited.

21. Public Domain materials (e.g., images, text and software programs) may be downloaded or uploaded using Transworld's services. Subscribers are prohibited to upload, post, publish, transmit, reproduce, distribute, or in any way, materials that are protected by copyright, trademark, or other proprietary right, without obtaining permission of the copyright owner or right holder. The Subscriber assumes all risks regarding the determination of whether the material is in the public domain.

(Note that some materials available on the global Internet are called Shareware. These materials may be downloaded and used, but they are copyrighted materials. The copyright holder usually gives permission to use the materials for examination. If you choose to continue using the materials, you may be obligated to register your use and pay a license fee to the copyright holder.) 22. The Subscriber acknowledges that Transworld makes an honest effort to keep information available on Transworld's systems accurate. However, Transworld can make no warranty of any kind, either expressed or implied, regarding the quality, accuracy, or validity for the data and/or information available. Use of information obtained from or through Transworld is at the sole risk of the Subscriber. System may be temporarily interrupted or curtailed with or without notice due to equipment modifications, upgrades, relocations, repairs, and similar activities necessary for the proper operation of the Service to the Subscriber.

23. Violation of any of Transworld's conditions of use are unethical and may be criminal offenses. You are expected to report to Transworld any information you may have concerning instances in which the conditions of use have been or are being violated. When Transworld becomes aware of possible violations, we will initiate an investigation. At the same time, in order to prevent further possible unauthorized activity, Transworld may deactivate service and access to the account in question. Confirmation of violations may result in cancellation of the individual account and/or criminal prosecution. The account suspension may be rescinded at Transworld's discretion, following payment of a reconnection charge.

24. If the Subscriber is dissatisfied with Transworld's service or with any terms, conditions, rules, policies, guidelines or practices, the customer's sole and exclusive remedy is to cancel service with Transworld. Prepaid Accounts terminated by Transworld for the violation of this Agreement will not be refunded. No exceptions! Transworld reserves the right to refuse service to anyone permitted by law.

25. Cancellation requests for Transworld's accounts must be received in writing via Email (From Subscriber's email account), Fax, or US Mail at Transworld Network's mailing address at P.O. Box 524, Torrance, California 90508 USA. Such requests must be received by 5pm PST on the 25th day of the prior month in order to be processed by the beginning of the next billing cycle. Pro-rated refunds will not be issued. Account Set-up Fees are non-refundable and non-transferable. Phone cancellations are not accepted.

26. Subscriber agrees to indemnify, defend, and hold harmless Transworld and its affiliates, its contractors, its agents, or their respective employees involved in creating, producing or distributing Transworld's services or software provided by third parties be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of or inability to use Transworld's service including but not limited to the deletion of files or Email, errors, defects, viruses, worms, Trojan horses, delays in operation or transmission, or any failure of performance, whether or not limited to acts of God, earthquake, labor disputes and strikes, telecommunication problems, riots, war, theft, fire, destruction, accidents, and governmental requirements, communications line failure, breach of contract, negligence, any other cause of action, or unauthorized access to, or alteration or use of Transworld's records, programs or services.

27. Transworld is not responsible for any computer viruses, worms, Trojan horses or other computer errors or defects. Transworld does not warrant or guarantee that programs or services uploaded or downloaded shall be free of all viruses. Any Subscriber found uploading a "virus" will be automatically terminated from the system and legal action will be pursued.

28. Transworld shall be indemnified, defended and held harmless by the Subscriber against all claims, losses or damages arising from the use of Transworld's service including but not limited to the following: a) Claims for libel, slander, invasion of privacy, infringement of copyright, or unauthorized use of any trademark, trade name or service mark arising out of the material, data information, or other content transmitted via Transworld's service.
b) Claims for patent infringement arising from combining or using Transworld's service in connection with facilities or equipment furnished by others.
c) Violation of anyone's right to privacy.
d) Violation of any other literary, intellectual, artistic, dramatic, musical right or other content transmitted using Transworld's service.
e) Claims related to lost or stolen credit cards, checks, electronic currency or other payment media.
f) All other claims arising out of any act or omission of others relating to Transworld's service pursuant to the Customer Agreement.

Pursuant to the Electronic Communications Privacy Act of 1986, Title 18, United States Code, Section 2510 and following, notice is hereby given that Transworld does not provide by its system for sending and receiving private or confidential messages. The system operator and anyone so designated by the system operator can and may read messages transmitted to or from any Subscriber.

29. Subscriber agrees that Transworld has the right to monitor Transworld's services electronically and to disclose any information as necessary to satisfy any law, regulation, or other governmental request.

30. Subscriber may not assign or transfer this Customer Agreement. This agreement shall be governed and construed in accordance with the laws of the State of California.

31. The failure of Transworld or the Subscriber to enforce at any time, any of the provisions, rights or options of the Customer Agreement shall in no way be considered to be a waiver of such provisions, rights or options or in any way affect the validity of the Customer Agreement.

32. Subscriber shall be deemed to have received notice for purposes of this Customer Agreement and any other policies, upon publication by Transworld on MoonLink.Net's, HamNet.Net's and GoCruising.Net's website. Requests for copies of this Agreement can be obtained by contacting our office.

THIS AGREEMENT CONSTITUTES THE ENTIRE AGREEMENT BETWEEN SUBSCRIBER AND TRANSWORLD NETWORK, INC. WITH RESPECT TO THE SERVICE.
